What Dower (Haq Mehr) Means Under Pakistani Law
Under Muslim personal law, dower (Haq Mehr) is money or property the husband must give the wife because of the marriage. It is not a gift and not a price. It is her legal right, and she alone may demand, keep or waive her dower.
Prompt Dower and Deferred Dower
Prompt dower (mu'ajjal) is payable on demand at any time after the Nikah. Deferred dower (muwajjal) becomes payable on dissolution of the marriage by divorce or death, or on any date the parties agreed. Many Nikah Namas split the Haq Mehr between both.
Section 10 of the Muslim Family Laws Ordinance 1961
Under section 10 of the MFLO 1961, where the Nikah Nama or marriage contract does not specify the mode of payment, the entire dower is presumed payable on demand. Our Dower Recovery Lawyers in Pakistan rely on this rule when the dower columns are blank or unclear.
Nikah Nama Columns on Dower — Where Your Haq Mehr Is Written
The standard Nikah Nama records the dower in columns 13 to 16. These entries are usually the main evidence in a Haq Mehr suit, so our dower lawyers read them first, alongside the signatures of the bride, groom, witnesses and the Nikah Registrar.
| Nikah Nama Column | What It Records About Dower |
|---|---|
| Column 13 | Amount of dower (Haq Mehr) fixed. |
| Column 14 | How much of the dower is prompt and how much deferred. |
| Column 15 | Whether any part of the dower was paid at the time of marriage, and how much. |
| Column 16 | Whether any property was given in lieu of the whole or part of the dower, with its description and agreed value. |
When the Dower Columns Are Blank or Altered
Blank, cut or overwritten dower columns are common. Our dower recovery lawyers obtain a certified copy from the Union Council and examine the Nikah Registrar's record. Where the columns are blank, section 10 of the MFLO and evidence of the agreed Haq Mehr become decisive.
Gold, House or Plot as Dower — Recovery of Property Dower
Many Pakistani Nikah Namas fix dower as gold ornaments, a house, a plot or a share in property. If the husband never transfers it, the wife can sue for delivery of the gold or property, or for its value, as part of her Haq Mehr claim.
Proving Gold Given as Dower
Where the Nikah Nama says gold was paid at the Nikah, the husband may later claim it was taken back. Our Dower Recovery Lawyers in Pakistan use the Nikah Nama entries, witnesses, photographs and jeweller receipts to prove who holds the dower gold today.
Property Promised as Haq Mehr
A house or plot written as dower in column 16 creates a claim the Family Court can enforce. The wife may seek transfer, possession or the value. Our dower lawyers check title documents first, because a property already sold to others needs a different strategy.

Dower Recovery Procedure in the Family Court — Step by Step
Dower is listed in the Schedule to the Family Courts Act 1964, so a Haq Mehr suit goes to the Family Court under section 5. The procedure is quicker than an ordinary civil suit, but documents and evidence still decide the dower claim.
| Step | What Happens in the Dower Case |
|---|---|
| 1. Consultation | Our lawyer reads the Nikah Nama dower columns and any payment record. |
| 2. Plaint | Dower recovery suit filed in the Family Court with territorial jurisdiction. |
| 3. Notice | Husband or heirs summoned; written statement filed. |
| 4. Pre-trial | Family Court attempts reconciliation under section 10. |
| 5. Evidence | Both sides lead evidence on the Haq Mehr and any payment. |
| 6. Decree | Judgment on dower under section 12 of the Act. |
| 7. Appeal | Appeal to the forum provided under section 14. |
| 8. Execution | Dower decree executed against the husband's money or property. |
Which Family Court Hears a Haq Mehr Suit
A dower suit is normally filed where the wife ordinarily resides, or where the couple last lived together. Our Dower Recovery Lawyers in Pakistan appear in Karachi, Lahore, Islamabad and Rawalpindi, and coordinate partner counsel in Hyderabad and Faisalabad for Haq Mehr cases.
Dower and Khula — What Happens to Haq Mehr
In a khula case the wife seeks dissolution and usually returns the benefits she received, which mainly means the dower. The Family Court decides how much Haq Mehr is returned or given up, so a wife should get advice before conceding her dower.
Dower When Divorce Is Given by the Husband
Where the husband pronounces talaq, the wife's unpaid dower, both prompt and deferred, becomes payable. A talaq does not cancel Haq Mehr. Our dower recovery lawyers often file the dower suit soon after the section 7 MFLO notice is received.
Dower Under Judicial Dissolution
Where marriage is dissolved on grounds under section 2 of the Dissolution of Muslim Marriages Act 1939, such as cruelty or failure to maintain, the wife's dower rights are not lost simply because she went to court. Each case depends on its facts and pleadings.
Time Limits for a Dower Claim in Pakistan
Dower claims are subject to limitation. In general, time for prompt dower runs from demand and refusal, and for deferred dower from dissolution of the marriage by death or divorce. Courts treat these rules carefully, so a delayed Haq Mehr claim should be checked early.
Why Early Advice on Dower Matters
Limitation turns on dates, demands and the wording of the Nikah Nama. Our Dower Recovery Lawyers in Pakistan review these facts at the first meeting and advise whether your dower suit is in time, rather than guessing from a general rule found online.
Documents Needed for a Dower Recovery Case
Bring these papers to your first meeting with our dower lawyers. A short one-page summary of facts saves time and fees. If you are overseas, clear phone photos of the Nikah Nama dower columns are enough to start.
- Nikah Nama, ideally a certified copy from the Union Council
- CNICs of both spouses (passport for overseas clients)
- Divorce deed, talaq notice, khula decree or death certificate if any
- Receipts, photos or messages about gold or property given as dower
- Property documents if a house or plot was written as Haq Mehr
